. . . I, Hinchea GILLIAM of Sussex County . . .

Item: I give and bequeath to my son Hinchea GILLIAM a part or parcel of land joining William Briggs' land, orphan of William Briggs deceased cut off from my other lands by a line beginning at William Briggs's line upon my Spring run, thence up the said run to a sweetgum on the South side of the Spring, thence about South-West to a walnut in the old orchard, thence to a straight line to an oak by Cook's pond, thence down a line of marked trees (between my Home plantation and the survey I made) to Benjamin Roberts' line on the side of the little Town Swamp. This outer or South parcel of my land cuts off from the rest by the aforesaid line I give unto my son Hinchea GILLIAM and his heirs forever.

Item: I give and bequeath to my son William GILLIAM a part or parcel of my remaining land lying upon Black Water beginning at the mouth of John Edmonds' Mill Swamp, thence up the said Edmonds' line to the fork of my Mill pond thence up the right hand fork of the pond the water course to a spring known by the name of the Hot Spring and from a hickory by the spring a line of marked trees to a hickory in Willett Roberts' line thence down the said Roberts' line to Black Water Swamp, thence down the said swamp to John Edmonds' line where it began. This part or parcel of land I give unto my son William GILLIAM and his heirs forever.

Item: I give and bequeath to my son John GILLIAM the remaining part of my land with all the improvements thereon to him and his heirs forever.

Item: I give and bequeath to my wife Amey all the remainder part of my Estate during her natural life or widowhood or until my oldest son arrives at the age of twenty-one, for the bringing up my children and my will and desire is that at my wife's death or marriage or when my eldest son arrives at the age of twenty-one that the whole estate shall be divided between my wife and children by two discreet persons. Also my will and desire is that if my estate should ever be divided as above and my wife have a separate part thereof, that at her oath it may return to my children and be equally divided between them. And also my will and desire is that if my sons die under age unmarried that what I have herein given him may be equally divided between the survivors.

Lastly I appoint my brother John GILLIAM, Thomas Chappell, and my wife Amy Executors and Executrix of this my last will and testament. In witness I have hereunto set my hand and affixed my seal this twelfth day of December, one thousand seven hundred and sixty-eight.

At a court held for Sussex County the 18th day of May 1769
The afore written last will and testament of Hinchea GILLIAM dec'd was presented into court by John GILLIAM and Amy GILLIAM two of the Executors therein named who made oath thereto as the law directs and the same was proved by the oaths of Willett Roberts, Benjamin Roberts, J. Mason the witnesses thereto and by the court ordered to be recorded, and on the motion of the said Executors certificate is granted them for obtaining a probate thereof in due form.
